{"id":1037,"date":"2026-07-21T07:02:52","date_gmt":"2026-07-21T07:02:52","guid":{"rendered":"https:\/\/marinersupdate.com\/blog\/?p=1037"},"modified":"2026-07-21T07:02:53","modified_gmt":"2026-07-21T07:02:53","slug":"sire-2-0-wk-64-defects-notifications-compliance","status":"publish","type":"post","link":"https:\/\/marinersupdate.com\/blog\/sire-2-0-wk-64-defects-notifications-compliance\/","title":{"rendered":"SIRE 2.0 &#8211; WK: 64 &#8211; Defects, Notifications &amp; Compliance"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Chapter 2.4.2<\/h2>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>Where defects existed to the vessel\u2019s structure, machinery or equipment, had the vessel operator notified class, flag and\/or the authorities in the port of arrival, as appropriate to the circumstances, and had short term certificates, waivers, exemptions and\/or permissions to proceed the voyage been issued where necessary?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p><strong>Applies to:<\/strong> Oil Tanker | Chemical Tanker | LNG | LPG<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Potential Ground for Negative Observation (OBS)<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>There was no company procedure which required that defects to vessel structure, machinery and equipment were evaluated by shore management to determine whether notifications to Class, Flag and\/or other external stakeholders were required.<\/li>\n\n\n\n<li>The senior officers were not familiar with the company procedure for notifying Class, Flag and\/or other external stakeholders of defects to the vessel\u2019s structure, machinery or equipment after shore management evaluation.<\/li>\n\n\n\n<li>There were open defect reports in the defect reporting system which were of a significant nature but there was no evidence that class, flag and\/or external stakeholders had been informed in accordance with the company procedure. In this case identify the defective equipment in the negative observation module of the Hardware response tool.<\/li>\n\n\n\n<li>Class, Flag or external stakeholders had imposed conditions on the vessel as a result of a defect to the structure, machinery or equipment but the vessel had no evidence that the conditions had been complied with.<\/li>\n<\/ul>\n\n\n\n<p>Where no defects existed that had been notified to, or would have required notification to, the vessel\u2019s Classification Society, Flag Administration and\/or other external stakeholders select <strong>&#8220;Not Answerable&#8221;<\/strong> in the Hardware response tool, then select <strong>&#8220;Not Applicable &#8211; as instructed by question guidance.&#8221;<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Checklist for You<\/h2>\n\n\n\n<p>\u2714 Are the senior officers familiar with the company procedure for notifying Class, Flag and\/or other external stakeholders of defects to the vessel\u2019s structure, machinery or equipment after shore management evaluation?<\/p>\n\n\n\n<p>\u2714 Are there any open defects of significant nature in the defect reporting system with no evidence that Class, Flag and\/or other external stakeholders had been informed in accordance with the company procedure?<\/p>\n\n\n\n<p>\u2714 If a short-term certificate or Flag State dispensation has been issued, are the specific mitigating measures or conditions required by Flag\/Class complied with?<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Guidelines<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Human<\/h3>\n\n\n\n<p>Senior Officers must be familiar with the company procedure for notifying Class, Flag and\/or other external stakeholders of defects to the vessel&#8217;s structure, machinery or equipment after shore management evaluation.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Process<\/h3>\n\n\n\n<p>The Master and Chief Engineer should have a printed list of all open defect reports on board, which must be provided to the <strong>Inspector<\/strong> for review during the inspection. The list should clearly identify any defects that have resulted in notifications to the vessel&#8217;s Classification Society and\/or Flag Administration.<\/p>\n\n\n\n<p>The vessel operator must have developed procedures for evaluating defects to the vessel&#8217;s structure, machinery, and equipment. These procedures should define when and how defects are reported to external stakeholders such as the Classification Society, Flag Administration, and other relevant authorities.<\/p>\n\n\n\n<p>Specifically, the procedure should address:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Which defects should be reported to external stakeholders.<\/li>\n\n\n\n<li>When and by whom these defects should be reported.<\/li>\n\n\n\n<li>How to manage short-term certificates or Flag waivers issued and the notification process.<\/li>\n\n\n\n<li>The records that must be maintained onboard to demonstrate that the appropriate notifications were made.<\/li>\n<\/ul>\n\n\n\n<p>During the inspection, the Inspector will review the Class Status Report to identify any Conditions of Class, memoranda, or short-term certificates that indicate defects. They will also examine the vessel\u2019s defect reporting system to verify that any defects reportable to the Classification Society or Flag Administration were properly communicated.<\/p>\n\n\n\n<p>If the vessel has a short-term certificate or Flag Administration waiver, the Inspector will check whether the vessel has notified the external stakeholders as required, especially during pre-arrival procedures or transit through controlled navigational areas.<\/p>\n\n\n\n<p>Additionally, if mitigating measures were required as part of the short-term certificate or waiver, the Inspector will confirm that these measures were implemented as stipulated.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Hardware<\/h3>\n\n\n\n<p>If there are open defect reports in the defect reporting system of a significant nature but there is no evidence that Class, Flag and\/or external stakeholders have been informed in accordance with the company procedure, the Inspector will identify the defective equipment and raise a negative observation under <strong>&#8220;Hardware.&#8221;<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Reference<\/h2>\n\n\n\n<p><strong>TMSA KPI 4.1.2<\/strong> requires that a defect reporting system is in place for each vessel within the fleet. The defect reporting system covers all onboard equipment and includes Conditions of Class.<\/p>\n\n\n\n<p><strong>IMO:<\/strong> ISM Code \/ 10.1, 10.2<\/p>\n\n\n\n<p><strong>IMO:<\/strong> SOLAS \/ Chapter I, Regulation 11<\/p>\n\n\n\n<p><strong>IACS:<\/strong> Information Paper \u2013 <em>Classification societies \u2013 what, why and how?<\/em><\/p>\n\n\n\n<p><strong>Section B1<\/strong> \u2013 The effectiveness of classification depends upon the shipbuilder, during construction, and the shipowner, once the vessel enters service, cooperating with the Class Society in an open and transparent manner on all issues which may affect its class status. For the shipowner, this particularly requires acting in good faith by disclosing to the Class Society any damage or deterioration that may affect the vessel\u2019s classification status.
